1. Who provides CoachTalk
These Terms govern your use of CoachTalk, a personal golf coaching service operated by Quantum Surprise, Unipessoal Lda, NIPC 518 139 247, registered in Portugal (the Company, we, us or our). CoachTalk is the service name. FoCoCo is a brand of the same Company and is not a separate contracting entity.

By creating an account or using CoachTalk you agree to these Terms and acknowledge the Privacy Policy. Different terms may apply to purchases made through Apple, Google or Stripe where stated at checkout and under applicable law.
2. Eligibility and account security
CoachTalk 1.5 is available only to users 18 years of age or older. You must provide accurate registration details, maintain the confidentiality of your account credentials, and notify us promptly of suspected unauthorised access. An account may require email verification before all features become available. Do not use an account belonging to someone else or submit another person's personal data without authority.
3. What CoachTalk provides
CoachTalk is designed to help golfers reflect on and develop the parts of their game beyond swing mechanics. It offers a connected Phone App and WebApp using the same eligible account. The Phone App supports golf conversations and capture while the WebApp supports coaching and review of your golf information. Current features may include conversations with CoachTalk, GameTalk captures, MindSnaps, round and practice records, PlayBack, insights and related coaching tools.
Available functions vary by platform, subscription, country and release. Some tools visible in older marketing materials, previews or development builds may not be included in your current membership. We do not provide shot-distance GPS in the 1.5 Phone App or guarantee access to features that have not been released.
CoachTalk generates some coaching responses and insights using artificial intelligence. It is not a live human coach, a replacement for your PGA professional, or a medical or crisis service. You remain responsible for choices you make on or off the golf course. We do not promise a particular score, handicap or performance result.
4. Membership and prices
CoachTalk offers monthly and annual paid membership options and, where eligible, a 14-day free trial. One eligible membership is intended to provide access to supported Phone App and WebApp features through the same CoachTalk account, subject to verification of the purchase and feature availability.
Prices depend on billing country, currency, platform and applicable taxes. Your actual amount, billing interval, trial details and renewal terms must be displayed clearly before you authorise payment. The amount displayed by the relevant billing provider at checkout governs that transaction, subject to mandatory consumer rights. Memberships billed through an app store are subject to that store's applicable purchase and subscription terms.
5. The 14-day trial
Trial availability and eligibility may differ by purchase channel. The trial start date, end date, eligible plan and what happens afterwards must be shown before signup.
- Web trial without a card: where CoachTalk offers signup without payment details, starting the trial alone does not authorise a charge. A paid subscription requires a later, affirmative payment authorisation.
- Apple or Google subscription trial: an eligible introductory offer may renew as a paid subscription under that store's stated terms unless cancelled within the store's deadline. The store controls payment details and renewal management.
- One trial may be restricted to eligible accounts or customers under clearly disclosed rules. We may refuse misleading or fraudulent repeated trial attempts.
6. Renewal, cancellation and account deletion
A paid recurring subscription normally renews for the billing interval you selected until cancelled, in accordance with the terms shown at purchase.
- Apple: manage or cancel through your Apple subscription settings.
- Google Play: manage or cancel through Google Play subscription settings.
- Web / Stripe: manage through the CoachTalk account and the provided Stripe customer portal, or contact support where that control is unavailable.
Cancellation prevents future renewals but does not necessarily remove access immediately. Access usually continues until the end of the paid period, unless the provider's terms or applicable law require otherwise. Deleting your CoachTalk account and cancelling an Apple or Google subscription are separate actions. Cancel store billing separately before account deletion.
7. Statutory withdrawal, refunds and consumer rights
If mandatory consumer law gives you a cooling-off or withdrawal right, you may exercise it under the applicable conditions, without needing to justify your decision. Rules can differ for services, digital content, purchases via an app store and services performed during a withdrawal period. We will not present ordinary renewal cancellation as a substitute for a legally available right of withdrawal.
For contracts concluded through an online interface, an accessible electronic withdrawal function may be required during the applicable period.
To exercise an applicable withdrawal right for a web purchase, send a clear statement to support@coachtalk.golf, identifying your name, account email, the contract or order concerned and its date. No reason is required. You may use the model wording: “I give notice that I withdraw from my CoachTalk contract concluded on [date], for account [email], order [reference if available].” Keep a copy of what you send. For help with a web purchase or refund, contact support@coachtalk.golf. For purchases made through Apple or Google, use the relevant store process where applicable, without prejudice to mandatory rights. Nothing in these Terms limits consumer rights that cannot legally be excluded.
8. Your golf content
You retain the rights you hold in the rounds, messages, notes, recordings and other content you submit. You grant the Company a non-exclusive licence to store, process, adapt and display that content to the extent needed to operate and personalise the CoachTalk service, secure it, and provide the purposes explained in the Privacy Policy. The licence ends for deleted content except where lawful retention or irreversible anonymisation applies.
Do not submit content you do not have the right to use, including another person's private data, voice recording or images without a lawful basis.
9. Responsible use
Do not use CoachTalk unlawfully, compromise security, harass others, submit malicious content, try to access another account, copy or resell the service without permission, or bypass legitimate technical restrictions. Limits on reverse engineering do not override rights granted by mandatory law.
Do not rely on CoachTalk while driving or where using your phone, voice features or screen could create a safety risk on the golf course. Follow the rules of golf, course instructions and local law.
10. AI-generated information and limitations
Coaching suggestions, classifications, summaries and possible patterns are generated from the information available to the system. They may be wrong, incomplete or unsuitable. Verify information that matters to you and use your own judgment. CoachTalk does not diagnose or treat health conditions. See AI & Coaching Transparency and Wellbeing.
11. Third-party services and integrations
The service depends on external infrastructure and, where relevant, app stores, subscriptions, voice, AI and payment services. Those providers may have their own terms. Features or integrations not yet released, including potential third-party golf-data imports, are not promised by these Terms.
12. Ownership and intellectual property
The software, designs, brand names, content and coaching frameworks used in CoachTalk belong to the Company or its licensors. CoachTalk, GameTalk and the MindGame System may be used as product or framework names; nothing in these Terms represents that every name is a registered trademark. Except for your own content and rights given by law, these Terms grant a limited, personal, non-transferable right to use the service while entitled to do so.
13. Changes, availability and account restrictions
We may change or improve the service and address security or operational issues. Where a change materially affects an active paid customer's core contracted service, we will provide notice and the protections required by law. We cannot promise uninterrupted service. We may restrict access where reasonably necessary for security, unlawful use, fraud or non-payment, with appropriate safeguards and notice where feasible.
14. Liability
We will provide the service with reasonable care and skill as required by applicable law. We are not responsible for specific golf outcomes or decisions taken in reliance on generated suggestions. Any exclusion or limitation of liability applies only to the extent permitted by law. Nothing excludes mandatory consumer rights or liability that cannot legally be excluded.
15. Governing law and disputes
Portuguese law applies, subject to mandatory consumer protections and jurisdiction rights in your country of residence. Please contact support@coachtalk.golf first with a concern. Information about Portugal's Livro de Reclamações Eletrónico and applicable consumer alternative dispute resolution is in Company & Legal Information. You retain the right to seek a court remedy where the law provides one.
16. Changes and contact
We may update these Terms when the service or law changes. Material changes will be communicated as required; existing customers' acquired contractual rights are respected under applicable law. Legacy promotional pricing, if contractually promised to eligible existing customers, continues only under the specific original offer conditions and is not advertised as a current public plan unless still offered.
